DeLisle of Cohen, Seglias, Pallas, Greenhall & Furman, P.C., Philadelphia, PA, counsel for Appellant. Jennifer Hedge, Office of Regional Counsel, Department of Veterans Affairs, Pittsburgh, PA, counsel for Respondent. DANIELS, Board Judge (Chairman). ORDER The Department of Veterans Affairs contracted with Teamus Construction Company, Inc. for the addition and replacement of mechanical systems at the James E. Van Zandt Veterans Affairs Medical Center in Altoona, Pennsylvania. During performance of the work, the parties disagreed as to the extent of piping that the contractor was required by the contract to replace. The contractor claimed that it was entitled to an additional $142,738 for replacing certain piping. An agency contracting officer denied the claim, and the contractor appealed his decision to the Board. CBCA 3975 2 Through mediation, with Board Judge Jonathan D. Zischkau serving as mediator, the parties settled the case. The contractor has asked the Board to dismiss the case with prejudice. Accordingly, the case is DISMISSED WITH PREJUDICE. _________________________ STEPHEN M. DANIELS Board Judge
