DISMISSED WITHOUT PREJUDICE: June 26, 2015 CBCA 4562 GWSI, INC., Appellant, v. DEPARTMENT OF HOMELAND SECURITY, Respondent. Kevin R. Boyle and Andrew S. Esler of Stradley Ronon Stevens & Young, LLP, Philadelphia, PA, counsel for Appellant. Kasia Dourney, Christian Butler, and John Sabatino, Office of Chief Counsel, Customs and Border Protection, Department of Homeland Security, Washington, DC, counsel for Respondent. KULLBERG, Board Judge. ORDER On February 20, 2015, GWSI, Inc. filed a notice of appeal concerning a decision by a contracting officer of Customs and Border Protection. The decision suspends the selection of GWSI as an operator of the Centralized Examination Station at the Port of Philadelphia and proposes to revoke and cancel GWSI’s status as an operator at that location. The Board questioned its jurisdiction to proceed with this matter. On June 24, 2015, the parties filed a joint motion seeking a dismissal without prejudice. GWSI is withdrawing the appeal without prejudice; the contracting officer is reconsidering the proposed revocation; and the parties have agreed upon a methodology of proceeding to a final administrative determination. In CBCA 4562 2 accordance with the request of the parties, the Board DISMISSES WITHOUT PREJUDICE the appeal; the issue of Board jurisdiction is moot. ______________________________ H.
