This appeal involves a General Services Administration (GSA) auction contract and a claim by appellant, The Compak Companies, LLC, for coins missing from among those advertised for sale. The matter has been settled by means of alternative dispute resolution (ADR) proceedings conducted by Board Judge Allan H. Goodman as neutral mediator, pursuant to Board Rule 54, 48 CFR 6101.54 (2014). The parties have filed a settlement agreement and release together with a joint stipulation of award, under which they seek an award in favor of appellant in the amount of $207,472.50, to be paid to appellant from the permanent indefinite judgment fund. CBCA 2545 2 Under their joint stipulation, the parties state that they will not seek reconsideration of, or relief from, the Board’s decision, and will not appeal the decision. In addition, under the settlement agreement and in consideration for the performance of its terms, appellant has waived and released respondent from any and all claims of any nature, including any right it may have to seek interest or the recovery of attorney fees. Decision The appeals are GRANTED IN PART. In accordance with the parties’ joint stipulation, the Board awards appellant, The Compak Companies, LLC, the stipulated settlement amount of $207,472.50. Rule 25(b). Payment of that amount shall be made from the permanent indefinite judgment fund, 31 U.S.C. § 1304 (2012). _________________________ RICHARD C.
