ORDER On March 20, 2025, RedOrange LLC filed an appeal of a final decision by a contracting officer of the Department of Agriculture, which was docketed by the Board as CBCA 8389. On December 4, 2025, the parties jointly requested that the appeal be resolved through binding arbitration. The parties each filed supplements to the record, position papers, replies, and affidavits or statements from witnesses. On April 21, 2026, the arbitrator held a conference with the parties, during which each party confirmed that the appeal would be resolved through binding arbitration, that each party would be bound by the judgment issued by the arbitrator, and that the judgment would not be appealable. CBCA 8389 2 On April 30, 2026, the arbitrator held another conference with the parties and presented an oral explanation of the binding resolution of the appeal, confirmed in the arbitrator’s memorandum dated April 30, 2026.
