ORDER
The Department of Veterans Affairs (VA) contracted with Legion Construction, Inc.
(Legion) for interior renovation and mechanical upgrades to a building at the VA Medical
Center in Jamaica Plain, Massachusetts. Legion claimed that it is entitled to be paid
$163,842 in compensation for delays to the project caused by the VA. The contractor
appealed from a deemed denial of the claim.
The parties have now resolved their dispute and settled the case. Legion moves the
Board, with the VAâs assent, to dismiss the case with prejudice.

Accordingly, the case is DISMISSED WITH PREJUDICE.
