On July 31, 2025, appellant, GAM3 Construction LLC, appealed the denial of its requested settlement amount ($1,561,291.69) related to the termination for convenience of its contract with respondent Customs and Border Protection, Department of Homeland Security. On January 6, 2026, the parties filed a joint stipulation and motion for a consent judgment in appellant’s favor in the amount of $1,561,291.69, the full amount in dispute in this appeal, with interest to accrue on the judgment starting on July 30, 2025, and running until the date that appellant receives payment. In the parties’ stipulation and motion, they CBCA 8532 2 noted that the settlement amount due to appellant was to be paid through the Permanent Indefinite Judgment Fund, fully resolved the dispute between the parties, and included all costs, fees, and interest. The parties further stipulated that they will not seek reconsideration of or relief from, and will not appeal, the Board’s decision awarding the stipulated amount. See Rule 25(b) (48 CFR 6101.25(b) (2024)). Decision The appeal is GRANTED. Respondent shall pay to appellant $1,561,291.69 in full settlement of this appeal, with interest under the Contract Disputes Act, 41 U.S.C. § 7109 (2018), accruing from July 30, 2025, until the payment date.
