DISMISSED FOR LACK OF JURISDICTION AS MOOT: July 23, 2025 CBCA 8119 MISSOURI HIGHER EDUCATION LOAN AUTHORITY, Appellant, v. DEPARTMENT OF EDUCATION, Respondent. Scott F. Lane of Thompson Coburn LLP, St. Louis, MO; and Jayna M. Rust of Thompson Coburn LLP, Washington, DC, counsel for Appellant. Candice Jackson and Tim Rushenberg, Office of the General Counsel, Department of Education, Washington, DC, counsel for Respondent. Before Board Judges LESTER, GOODMAN, and SULLIVAN. SULLIVAN, Board Judge. By joint motion filed July 21, 2025, the parties seek dismissal of the appeal because the contracting officer for the Department of Education has withdrawn the decision that Missouri Higher Education Loan Authority appealed. Because the withdrawal of the decision in which the Government asserted a claim resolves the dispute, “there is nothing left for the Board to decide, and dismissal of the appeal as moot is appropriate.” Avue Technologies Corp. v. Agency for Global Media, CBCA 6752, et al., 20-1 BCA ¶ 37,639, at 182,755. CBCA 8119 2 This appeal is DISMISSED FOR LACK OF JURISDICTION AS MOOT. Marian E. Sullivan MARIAN E.
