LESTER, Board Judge. ORDER West Coast Contractors, Inc., appealed a contracting officer’s decision denying its claim for a fixed-unit-price variable quantity contract for the removal and replacement of two single-lane bridges. The parties participated in an alternative dispute resolution (ADR) session with Board Judge Marian E. Sullivan in an attempt to settle the disputes in question. Following the ADR, the parties filed a motion to dismiss, stating the parties have entered into a settlement CBCA 4113 2 agreement wherein payment has been received by appellant, and requesting the case be dismissed with prejudice.
