ORDER Under a contract with the General Services Administration, Endeavors Unlimited provided custodial services and grounds maintenance at the United States Customs and Border Protection Station in Eagle Pass, Texas. The contractor claimed that because pedestrian and vehicular traffic at this station increased over the three years of contract duration, the costs of performing the contract increased by $134,994.19. The contracting officer did not issue a decision on the claim, and the contractor appealed from his deemed denial. CBCA 5486 2 Through mediation conducted by Board Judge Kyle Chadwick, the parties have resolved their dispute. The agency has moved the Board to dismiss the appeal with prejudice, and the contractor does not object to our granting the motion.
