ORDER The Department of Justice’s Federal Bureau of Investigation (FBI) contracted with Turner Construction Company (Turner) for construction of a facility in Clarksburg, West Virginia. The parties disagreed about the extent to which the contract required a professional engineer or licensed land surveyor to be on site for the erection of precast concrete panels. Turner submitted two claims for additional compensation due to such an individual’s presence, one in the amount of $88,161 and the other in the amount of $24,808. An FBI contracting officer denied the claims, and Turner appealed his decision. CBCA 4742 2 On the eve of a scheduled hearing, Turner moved the Board to dismiss its appeal. The motion is granted.
