ORDER On June 16, 2016, CTA I, LLC (CTA) appealed the deemed denial of a claim it had made under a contract for renovations to the Department of Veterans Affairs (VA) Medical Center in Asheville, North Carolina. CTA characterized its claim as “requesting that the VA acknowledge that it is in breach of contract and that CTA is relieved from further performance under the Contract.” On June 30, 2016, CTA informed the Board that the VA has terminated this contract for the convenience of the Government. The appellant said that “[t]his renders CTA’s CBCA 5363 2 request for declaratory relief on whether it must continue performance moot” and requested that the appeal be dismissed without prejudice.
