DISMISSED WITH PREJUDICE: April 7, 2017 CBCA 5657 SARATOGA INVESTMENTS, LLC, Appellant, v. DEPARTMENT OF AGRICULTURE, Respondent. Randy Harrison of Saratoga Investments, LLC, Saratoga, WY, appearing for Appellant. Daniel B. Rosenbluth, Office of the General Counsel, Department of Agriculture, Golden, CO, counsel for Respondent. LESTER, Board Judge. ORDER On February 21, 2017, appellant, Saratoga Investments, LLC (Saratoga), filed this appeal of a contracting officer’s decision dated February 8, 2017, in which the contracting officer for the United States Forest Service denied Saratoga’s previously submitted claim seeking $1800 in moving equipment expenses under a timber sale contract. By order dated February 22, 2017, the Board acknowledged Saratoga’s request to invoke the Board’s accelerated procedure pursuant to Board Rule 53 (48 CFR 6101.53 (2016)), and this appeal CBCA 5657 2 has proceeded accordingly. On April 3, 2017, however, Saratoga notified the Board that it had decided to withdraw its appeal, and, on April 7, 2017, it confirmed that it never intends to resubmit it. Accordingly, this appeal is DISMISSED WITH PREJUDICE. _________________________________ HAROLD D. LESTER, JR. Board Judge
