Highlights
A firm protested a Department of the Navy contract award for various services at the Naval Support Activity, contending that Navy's evaluation and sourcing decision was improper. GAO held that the evaluation supporting the cost/technical tradeoff selection decision contains material defects under two of the three technical factors, and the tradeoff analysis is based on an erroneous assumption about the relative price difference. Accordingly, the protest was sustained and GAO recommended that Navy (1) reopen discussions if necessary, (2) request and evaluate revised proposals, (3) make a new source selection decision, and (4) reimburse the protester its cost of pursuing the protest, including reasonable attorney's fees.
